The Supreme Administrative Court’s Chief Justice Oleksandr Paseniuk believes that the District Administrative Court of Kyiv interfered in the constitutional powers of the President of Ukraine by considering the Yulia Tymoshenko Bloc’s appeal over the legality of the presidential decree that dissolved the parliament.
Paseniuk was speaking at a conference of administrative court judges.
According to Paseniuk, the District Administrative Court of Kyiv’s judge Volodymyr Keleberda abused his judicial powers by agreeing to consider the Yulia Tymoshenko Bloc’s lawsuit.
Paseniuk said that the law was exclusively in the jurisdiction of the Constitutional Court.
«In this case, we have an unlawful interference in the constitutional powers of the President, issues about which should be resolved exclusively by the Constitutional Court,» Paseniuk said.
Moreover, Paseniuk called on judges to act properly in such situations.
He also called for judges that abuse their powers by issuing unlawful decisions to be removed from their posts.
As Ukrainian News earlier reported, the Prosecutor-General’s Office is investigating three criminal cases that were filed in connection with Keleberda’s decision to consider the appeal against the presidential decree that dissolved the parliament.
The Presidential Secretariat believes Keleberda’s decision to consider the appeal against the dissolution of the parliament was illegal.
President Viktor Yuschenko cancelled the appointment of Keleberda as a judge at the District Administrative Court of Kyiv on October 10.
The District Administrative Court of Kyiv decided on October 10 to suspend the presidential decree No. 911 that dissolved the parliament.
