Kyiv's Administrative Court Of Appeal To Consider Presidential Secretariat 's Appeal Against Suspension Of Rada's Dissolution October 13 (08:33, Monday, October 13, 2008)

Kyiv's Administrative Court of Appeal has postponed examination of the Presidential Secretariat's appeal against suspension of President Viktor Yuschenko's decree on dissolution of the Verkhovna Rada until October 13 based on the Yulia Tymoshenko Bloc faction's solicitation.

Ruslan Kyryliuk, head of the Presidential Secretariat's Service for defending president's interests at courts, announced this to reporters.

He said the BYuT had solicited for claiming the original of the case from Kyiv's District Administrative Court at the court hearing on Sunday.

Kyryliuk thinks Kyiv's Administrative Court of Appeal has the right to consider the case based on copies provided by Kyiv's District Administrative Court.

He is convinced the BYuT is trying to drag out the proceeding through taking illegal actions.

"This is a vivid fact of raidership" he said.

Kyryliuk noted in connection with the start of the election campaign judges work in days-off and are entitled to hear appeals before expiry of 5 days after the District administrative court decision.

The hearings are slated for 4:00 p.m. October 13, her noted.

As Ukrainian News reported, the President's Secretariat claims about criminal responsibility the Yulia Tymoshenko Bloc faction deputies may bear for preventing appeals against suspension of President Viktor Yuschenko's decree on dissolving the Verkhovna Rada and calling early parliamentary elections.

The District Administrative Court of Kyiv suspended presidential decree No. 911 on terminating the Verkhovna Rada's powers

The Presidential Secretariat appealed against this court decision at Kyiv's Administrative Court of Appeal.

The snap parliamentary election campaign has been suspended since 9:00 a.m. October 11 after the president's decree on dissolving the Rada was waived.

President Viktor Yuschenko called the early parliamentary elections for December 7.
