Justice Minister Mykola Onyschuk believes that an appeal against the presidential decree on dissolution of the parliament and organization of early parliamentary elections can be filed only with the Constitutional Court.
Onyschuk announced this to Ukrainian News.
"The Justice Ministry proceeds from the belief that legal relations regarding the President of Ukraine's termination of the powers of the parliament and the scheduling of early parliamentary elections are regulated exclusively by the Constitution of Ukraine and that they should be challenged exclusively in the Constitutional Court," Onyschuk said, adding that other courts do not have the power to consider such decree or make any decisions on them.
As Ukrainian News earlier reported, the Justice Ministry does not intend to implement decisions made by ordinary courts on the presidential decree that dissolved the parliament and ordered early parliamentary elections.
The Presidential Secretariat has announced that the Yulia Tymoshenko Bloc has appealed to the District Administrative court of Kyiv against President Viktor Yuschenko's decree that dissolved the parliament and scheduled early parliamentary elections.
