Prosecutor General's Office of Russia has refused extradition of Volodymyr Satsiuk, former first deputy chairman of the Security Service of Ukraine (SBU), to Ukraine due to the fact that he is the Russian citizen.
This reads the statement of the press service of the Ukrainian Prosecutor General's Office.
According to the statement, in April, Ukrainian Prosecutor General's Office presented a petition to the Prosecutor General's Office of Russia on extradition of Satsiuk to Ukraine.
The military prosecutor's office of the central region has a criminal case against the former first deputy chairman of the SBU on alleged abuse of power, abuse of office and forgery in office resulting in grave consequences.
Prosecutor General's Office of Russia responded that Satsiuk is a citizen of Russia.
So, pursuant to Article 61 of the Russia's Constitution and Article 57 of the Convention on legal redress and legal relationship in civil, family and criminal cases, it is impossible to extradite Satsiuk to law enforcement agencies of Ukraine.
Pursuant to Article 61 of the Constitution of Russia, a citizen of Russia can't be sent out of the state or extradited to other state.
As Ukrainian News earlier reported, on May 21, the Prosecutor General's Office filed a criminal case against Satsiuk, former first deputy chairman of the Security Service of Ukraine (SBU) on alleged abuse of office.
In May 2004 then President Leonid Kuchma appointed Satsiuk as first deputy chairman of the SBU.
Later Prosecutor General's Office filed a criminal case against Satsiuk on misappropriation of military rank and in 2005 announced the arrest warrant for him.
